1. General Provisions

  1. These terms and conditions define the rules for making purchases in the online store operated at www.manuelcastanon.com

  2. The owner and operator of the store is Manuel Castañon Guerrero, Tax ID: 1132951365, Józefa Siemieńskiego 19/51
    02-106 Warsaw, Mazowieckie.

  3. These terms and conditions are binding for the Seller and all Customers placing orders and making purchases in the online store.

2. Definitions

  1. Terms and Conditions – this document defining the rules of purchase.

  2. Store – online store available at https://www.manuelcastanon.com/shop

  3. Seller – Manuel Castañon Guerrero, Tax ID: 1132951365, Józefa Siemieńskiego 19/51

  4. Customer – a natural person, legal entity, or organizational unit without legal personality that makes purchases in the Store.

  5. Product – Magic the Gathering “Artist proof” blank-backed cards, and custom artwork commissions done by hand in traditional media.

  6. Legal provisions – in particular the Civil Code, the Consumer Rights Act of May 30, 2014, the Personal Data Protection Act.

3. Product Information

  1. Magic: The Gathering Artist Proofs are highly sought-after collector’s editions of the cards. They feature white backs and are produced exclusively for the artist in very limited quantities. Each proof is signed by the original artist of the artwork featured in the card: Manuel Castañón.

  2. Each Artist proof of a fulfilled order is sent in a cardboard envelope, carefully packaged and protected by a combination of soft and hard card sleeves affixed to a cardboard backing.

  3. All Artist proofs offered in the store are results of Magic the Gathering’s printing process, and can be used in the game in all formats except for tournaments.
    As they are of limited quantity, once the stock is gone they are unavailable in perpetuity.

  4. The signatures and artwork made for each Artist proof is handmade and thus unique.
    Due to the hand made nature of the custom artwork – small differences in execution and quality caused by human error between individual commissions are to be expected and acceptable e.g. slight blurs or paint blots in artwork or signatures.

4. Prices

  1. All Product prices are given in Euro (EUR)

  2. Prices do not include shipping costs, unless stated otherwise in the Product description.

  3. The binding price is the price indicated for the Product at the time of placing the order.

5. Placing Orders

  1. The Customer can place an order through the Store’s website.

  2. A condition for order fulfillment is the correct provision of data necessary for delivery.

  3. Placing an order means concluding a sales contract between the Customer and the Seller.

6. Payments

  1. The Store offers the following payment methods:

    • electronic payments through the Stripe system,

    • online card payment (Visa, Mastercard),

    • Paypal

  2. Payment is considered made when funds are confirmed by Stripe or Paypal.

7. Delivery

  1. Delivery is carried out internationally through Polish Post (Poczta Polska) available worlwide.

  2. Alternatively customer might select Fedex as a carrier for their order.

  3. Delivery costs are indicated when placing the order.

  4. Delivery is usually a matter of weeks, could be longer depending on the distance and customs of receiving country, please be aware of import notices and extra costs that might need to be covered before your package can be delivered to you, seller denies responsibility for any such extra costs incurred by the customer.

  5. Artist proofs will arrive in one or more envelopes, depending on the amount ordered, double sleeved and secured to a carboard surface to prevent bending and damage.

8. Right of Withdrawal from Contract

  1. A Customer has the right to withdraw from purchase as long as the order hasn’t been shipped or modified in any way yet, this can be done by contacting the seller via email at manuelcgart@gmail.com

  2. Once handmade alterations have been made on any the ordered items, such as a signature or any kind of custom artwork, the customer loses the right to refund, according to Polish law.

  3. Should the package be completely lost or damaged during shipping, and ample proof provided from video evidence made at the time of the opening or receiving of the sealed package, or via the tracking number provided by Poczta Polska, The customer is allowed a full refund of order costs, send an email with the aforementioned evidence to manuelcgart@gmail.com

10. Personal Data Protection

  1. The administrator of the Customer’s personal data is the Seller.

  2. Personal data is processed for the purpose of order fulfillment and Customer service.

  3. The Customer has the right to access the content of their data and to correct it.

  4. Seller assures he will not share or sell the customer's data to any third parties under any circumstances.

11. Final Provisions

  1. In matters not regulated by these Terms and Conditions, Polish law applies.

  2. Disputes arising from the application of the Terms and Conditions will be considered by the court with jurisdiction over the Seller’s registered office, unless legal provisions state otherwise.

  3. The Terms and Conditions are effective from the date of publication on the Store’s website.
